Personal Injury Law covers a wide array of conduct that results in people being physically or emotionally injured.

 

The law requires all persons and corporations to act in a cautious and careful manner to avoid causing injury to others. While there are many specific laws and/or statutes protecting a person’s right to be free from conduct which results in injury, the most basic of these protections is the common law tort of “negligence”. 

 

In a negligence action, the injured party who sues for damages is called the plaintiff and the party being sued is called the defendant. To prove a negligence claim a plaintiff must prove that the defendant owed a duty to the plaintiff, failed in that duty (i.e. to be reasonably careful), and that damages resulted as a cause of that failure.    

 

The laws relating to personal injuries are primarily designed to have the person or company who negligently caused the injury to pay damages to fairly compensate injured persons for their loss.
